Maritime Questions › Legal / Command
During your oral exam you are asked: what is the significance of the "Workboat Code" (or equivalent commercial small vessel code) certificate for a vessel under 500GT, and what happens if the vessel operates outside the category for which it is certified?
A. The certificate is advisory only and operating outside its category has no consequence as long as the vessel is seaworthy
B. The certificate only restricts the number of crew, not the operating area
C. Workboat Code certificates have no expiry and do not require renewal or survey
D. The certificate specifies the operating category (area of operation, e.g. distance from a safe haven) and conditions under which the vessel may operate; operating outside this category invalidates the certificate, may breach insurance/P&I cover, and exposes the Master and company to liability and potential prosecution if an incident occurs

A. The Master may only render assistance after receiving written authorisation from the company
B. The duty to render assistance does not apply if the persons are suspected irregular migrants — the Master may legally ignore them and continue on passage
C. The duty to render assistance to persons in distress at sea overrides immigration status considerations at the point of rescue; the Master must rescue and provide for their safety, while disembarkation arrangements and any immigration questions are a separate matter to be coordinated afterward with flag state, coastal state authorities and the company/DPA
D. Rendering assistance is discretionary and depends on whether the vessel has spare cabins
