The Deadline That's Actually Approaching

It's easy to see "Workboat Code Edition 3" in an industry newsletter and think there's a new code coming. There isn't — it's already here. WB3 replaced Workboat Code Edition 2 (introduced December 2018) and the original 1998 "Brown Code" / MGN 280(M), and it has been in force since 13 December 2023. What's actually approaching is the transitional compliance deadline for vessels still certificated under the old codes: 13 December 2026, or the vessel's next renewal examination if sooner. Get the framing right before you plan around it — this is a deadline to prepare for, not a code to wait for.

Who This Affects

The Code applies to workboats and pilot boats under 24 metres load line length, plus Remotely Operated Unmanned Vessels (ROUVs) — vessels with no persons on board, operated remotely. If your vessel currently holds certification under the Brown Code, MGN 280(M), or Workboat Code Edition 2 Amendment 1, the transitional clock applies to you: comply by your next renewal examination, or three years after the Code's 13 December 2023 entry into force — whichever is later. In practice, for most existing vessels that means the 13 December 2026 backstop. ROUVs are a separate case — because they're newly regulated under this Code rather than transitioning from an older one, they've had to meet the Section 31 requirements below from the day the Code came into force, with no three-year grace period.

What "Comply" Actually Means

The headline change isn't a new piece of equipment to fit — it's a shift from a prescriptive equipment checklist to a risk-based Safety Management System. Section 31.2 requires every vessel owner/operator to implement an SMS proportionate to the size and complexity of the vessel and the operation, covering both terrestrial and marine aspects of running the vessel. Appendix 8 sets out the specific areas an SMS has to address. Separately, Section 31.3 introduces a formal cyber security obligation for the first time — measures to protect the vessel and crew from cyber-attack risk, referencing IMO resolution MSC.428(98), scaled to the size and complexity of the operation. If your vessel uses lithium-ion or lead-acid battery propulsion (exclusively or in a hybrid system), Annex 1 layers on additional ventilation, charging, training and disposal requirements, read alongside MGN 550.

The Real Risk Isn't the Code, It's the Queue

The MCA and the Workboat Association issued a joint message on this specifically: "check the code, prepare the vessel, book the survey." The concern isn't that operators won't eventually comply — it's that everyone leaves their renewal survey until late 2026, certifying authorities run out of slots, and vessels end up tied up waiting to be seen. IIMS, which runs CPD training for surveyors and operators on WB3, has been flagging the same congestion risk. The fix is entirely within your control: book early, not at the deadline.

What To Do Now

Confirm which code your vessel currently holds certification under, and work out your actual deadline (next renewal, or 13 December 2026 — whichever is sooner).
Start building or reviewing your SMS against Appendix 8's requirements now, not the week before survey.
If you run battery-hybrid or battery-electric propulsion, check Annex 1 and MGN 550 specifically — this is new ground for a lot of operators.
Book your renewal survey slot early. This is the single most controllable variable in the whole process.
