Loss of or Damage to Property: A Master's First-Hour Response Guide

P&I loss-prevention material is consistent on one point: what a Master does in the first hour after discovering lost or damaged cargo or third-party property shapes whether the resulting claim is defensible or not — far more than anything that happens afterwards in a formal investigation.

Preserve Evidence Immediately, Not Eventually

Photographs, witness statements, retained samples, and timestamped log entries taken in the first hours after discovery are consistently what P&I clubs point to as the difference between a claim the company can actually defend and one it can't. Waiting until "there's time to do it properly" is how this evidence gets lost — take it rough and immediate over polished and delayed.

Document Before Cargo Is Released, Not After

A Master's letter of protest, or a notation of damage on the mate's receipt or bill of lading, needs to happen before the cargo leaves the ship's custody — not as a follow-up once it's already been discharged and released. This is a common timing failure: the damage is real and documented internally, but the formal notation that actually protects the ship's position never gets made before release.

Report Before You Say Anything to a Third Party

The single most common Master-level mistake loss-prevention guidance warns against is making any admission or informal settlement offer to a cargo owner or third party before reporting to owners and the P&I correspondent. It's an understandable instinct — someone is upset, you want to de-escalate — but an informal apology or offer can materially affect the company's legal position before anyone ashore even knows there's a claim forming.

The Sequence That Actually Protects Everyone

Preserve evidence, document formally before release, report to owners/P&I immediately, and only then engage in any substantive discussion with the affected party — in that order, not improvised in the moment.
